Dioceses in the Province of Canada |
1. When the office of Metropolitan becomes vacant, the diocesan bishop senior by consecration shall decide whether the electoral college will be convened in person or by telecommunications. 2. If the electoral college is convened by telecommunications, these rules of procedure shall apply. 3. The senior bishop shall determine the date balloting is to begin. 4. The Prolocutor, in consultation with the officers of the Synod, shall appoint two scrutineers to receive and count ballots. Both scrutineers shall have access to e-mail and fax facilities, and good knowledge of their operation. The scrutineers shall not be members of the Provincial Council, nor members of the same diocese. 5. The Prolocutor, by ordinary mail, e-mail or fax, shall send, or cause to be sent, to each member of the Provincial Council, not less than thirty days before the date balloting is to begin:
6. Members of the Provincial Council shall transmit their ballots to both scrutineers by e-mail or fax within 48 hours after the time balloting is to begin, at which time balloting shall close. 7. The scrutineers shall each confirm reception of the ballots to each voting member by return e-mail or fax. 8. The scrutineers shall confer regarding the number of ballots cast in total for each order, and the number cast for each candidate by each order. 9. In compliance with the requirement of section 1(4) of Canon II for a secret ballot, the scrutineers shall receive ballots in strict confidence and shall not disclose any information about the ballots other than as set forth in section 8. 10. If a ballot is received by only one of the scrutineers, the other scrutineer shall contact the voter and request a re-transmission of the ballot. 11. A ballot shall not be validly cast unless both scrutineers receive the ballot. 12. If a bishop does not receive a majority of the ballots cast by each order, the scrutineers shall notify the members of the Provincial Council by return e-mail or fax within 48 hours after the closing of balloting, reporting the results of balloting by each order for each candidate, and the next balloting shall take place seven days after the date balloting began. 13. Balloting shall continue weekly until a bishop receives a majority of the ballots cast by each order, at which time the scrutineers shall each notify the Prolocutor by e-mail or fax, reporting the results of balloting by each order. 14. The Prolocutor, on being satisfied that the report is in compliance with Canon II:

If no objection is made with respect to the balloting within 10 days after the Prolocutor sends a copy of the report to each member of the Province Council, the scrutineers shall destroy all of the ballots received by fax and shall erase all e-mail messages containing ballots received by e-mail.
